Abstract

What is the impact of immigrant characteristics on the assignment of distant court locations? The Executive Office for Immigration Review has geographical guidelines by which it follows for assigning court locations, yet the median non-detained immigrant resides over a two hour drive from their assigned court and 25% are assigned locations more 17 hours away. This paper seeks first to understand what predicts distant court assignments that contradict the court’s geographical guidelines, and second to examine the impact of immigrant characteristics and behaviors on approval for a court location change or a virtual hearing.
