I examine AI-based privacy offenses, as perpetrated by EU member states in their 'smart border' control practices, and as recorded by watchdogs like Privacy International, Hermes Center for Transparency and Digital Human Rights, the European Data Protection Supervisor (EDPS) and the European Data Protection Board (EDPB). Increased undocumented arrivals, along increased prominence of populist or xenophobic political discourse, are analyzed along industry-driven securitization efforts, as possible drivers of AI-based privacy offenses, like the abusive use of facial recognition, social media scraping and biometric authentication.
